WinGD Challenges Korean Engine Patent Invalidation In Court

Swiss engine manufacturer Winterthur Gas & Diesel Ltd. (WinGD) has filed a lawsuit with the Korean Patent Court in April 2025, seeking to overturn a March 2024 decision by the Korean Intellectual Property Trial and Appeal Board (KIPTAB) that invalidated one of its patents related to large piston engines.

The disputed patent, Korean Patent No. 2095598, covers a combustion engine equipped with a crosshead and a control apparatus for adjusting the compression ratio—technology used in large marine or stationary engines. The invalidation challenge was brought by MAN Energy Solutions, which argued that the invention lacked novelty and inventive step.

In parallel with the court action, WinGD also filed a correction trial with KIPTAB to amend the patent's claims. Correction trials are typically pursued when invalidation risks are high, as narrowing claim scope may preserve patent validity. However, amended claims may require a fresh infringement determination.
