Korean Court Invalidates One LMS Patent, Rules No Infringement on Another in Initial Ruling

Sangbo has successfully countered LMS's patent infringement claims, securing both the invalidation of one patent and a favorable ruling in the first instance on another. The Seoul Central District Court ruled in July 2024 that Sangbo had not infringed on one of LMS's patents, while another LMS patent was invalidated earlier in the process.
LMS originally filed a patent infringement lawsuit against Sangbo in November 2020, targeting two of its optical sheet module patents: KR1268085 ("Optical Sheet Module Having Optical Sheet with Junction Pattern") and KR1268083 ("Laminate Optical Sheet Module"). These patents relate to technologies designed to enhance the performance of backlight units (BLUs) in liquid crystal displays (LCDs) by increasing brightness and optical efficiency.
The '085 patent focuses on an optical sheet module with two stacked optical sheets (upper and lower) that refract and concentrate light. Key components of the patent include the upper and lower optical sheets, a junction pattern that reduces light loss by minimizing bonding areas, and a reflective polarizing film that selectively transmits light to boost brightness.
The '083 patent involves a laminate optical sheet module aimed at improving BLU performance through a structure that enhances light concentration and transmission. The technology includes stacked optical sheets with inclined light-collecting structures that reduce the cross-sectional area toward the top, designed to reduce light loss and increase brightness.
In March 2021, Sangbo filed invalidation trials with the Korean Intellectual Property Office (KIPO) for both patents. While the invalidation attempt for the '085 patent was rejected by KIPO in September 2021, Sangbo's challenge to the '083 patent succeeded. In December 2021, KIPO ruled the '083 patent invalid. LMS subsequently appealed to the Patent Court in February 2022 but was defeated in June 2023.
As the patent invalidation proceedings continued, the infringement case moved forward in the Seoul Central District Court, where LMS's claim was dismissed in July 2024. LMS has since appealed the first-instance decision to the Patent Court.
