On October 7, 2024, non-practicing entity (NPE) Big Will Enterprises Inc. filed a patent infringement lawsuit against Kia America Inc. in the Western District of Texas.
The lawsuit centers on five patents that emphasize technology innovations in media management, image processing, and personalized content delivery.
The patents in question include:
US10,521,846: "Targeted advertisement selection for a wireless communication device (WCD)," covering systems for interactive aerial imaging. This technology is designed to capture high-resolution images from airborne vehicles, providing users with real-time access to applications like mapping and surveillance.
US9,049,558: "Systems and methods for determining mobile thing motion activity (MTMA) using sensor data of WCD," involving digital image management systems that organize and share images across multiple platforms with features such as tagging and categorization.
US8,737,951: "Method and apparatus for interactive target-based image searching," which allows users to interactively search images based on specific, user-defined target parameters.
US8,559,914: "Systems and methods for handling electronic media," describing a system for processing and distributing digital media, such as images and videos, optimizing how they are managed across various platforms.
US8,452,273: "Dynamic content management and distribution system," detailing a system for managing and distributing content tailored to users' devices based on factors such as bandwidth.
Notably, the '846 and '951 patents focus on image management and interactive searching technologies, while the '914 and '273 patents deal with systems for optimizing media distribution.
The five patents in dispute, owned by Big Will Enterprises, cover essential technologies in digital media management, content delivery, and real-time image processing. If infringement is proven, Kia's advanced infotainment systems could be affected, particularly in models equipped with cutting-edge tech.
The patents asserted in this lawsuit were originally part of a portfolio of eight patents that Big Will Enterprises acquired from Iot Human Messaging, LLC in January 2020. Since the acquisition, the NPE has initiated multiple lawsuits against high-profile companies, including Uber Technologies Inc., The American Automobile Association Inc., and Autoliv AB, alleging patent infringement. Kia America, known for its best-selling models like the Sportage and Telluride, is now facing a patent infringement lawsuit that could significantly impact its multimedia systems.
This case underscores the increasing trend of NPEs targeting connected car and digital content industries, potentially setting a key precedent for future patent disputes in the automotive sector.
