Sony Initiates Four IPR Proceedings Against OIT Patents

Sony has formally initiated inter partes review (IPR) proceedings at the U.S. Patent Trial and Appeal Board (PTAB) against four U.S. patents owned by Optimum Imaging Technologies LLC (OIT). 

Sony's IPR petitions were filed between May and June 2024, with all four cases being instituted by the PTAB between November 2024 and January 2025. Notably, this action marks Sony's challenge against OIT's technology portfolio, originally developed by Neal Solomon and acquired by OIT in 2019.

The patents under review include:

U.S. Patent No. 10,873,685 ("Digital imaging system for correcting video image aberrations")

U.S. Patent No. 8,451,339 ("Digital imaging system for correcting image aberrations")

U.S. Patent No. 7,612,805 ("Digital imaging system and methods for selective image filtration")

U.S. Patent No. 10,877,266 ("Digital camera with wireless image transfer")

The IPR challenges are not solely the domain of Sony. Industry peers including Fujifilm, OM Digital Solutions, Nikon, Panasonic Entertainment & Communication, and Olympus filed their own IPR petitions on these four patents between August and October 2024, while Samsung Electronics initiated its IPR petitions on the same patents between January and February 2025. To date, aside from Sony's four instituted IPRs, no other petition decisions have been finalized.

Earlier, in October 2023, OIT had brought six patent infringement lawsuits in the Eastern District of Texas against major digital camera manufacturers, relying on these same four patents. 

In a related matter, OIT had also filed a similar infringement suit against Canon in 2019 involving the '805 and '339 patents—a case that was ultimately settled out of court after Canon's IPR filing in 2020 was not instituted by the PTAB.
