Geobrugg Korea has failed to achieve its desired outcome in a proactive scope confirmation trial against Donga Special Construction.
In July 2024, Geobrugg Korea filed two proactive scope confirmation trials against Donga Special Construction, asserting that the company's products infringed its Korean patent, 'slope stabilization system using rhombus type high tensile wire rope net panel' (KR1027029). A proactive scope confirmation trial is a proceeding in which a patent holder seeks a ruling from the Intellectual Property Trial and Appeal Board (IPTAB) affirming that a competitor's product falls within the scope of its patent.
The IPTAB dismissed one of the two trials in September 2024. In March 2025, the board issued a ruling rejecting the remaining trial, meaning that neither of Geobrugg Korea's claims was accepted.
Previously, in December 2022, Donga Special Construction had filed a reactive scope confirmation trial against the same patent, seeking a ruling that its products did not infringe. The IPTAB dismissed the request in May 2023, and the decision was subsequently finalized.
The patent dispute between Geobrugg Korea and Donga Special Construction in South Korea has now entered its third year. The contested patent remains the sole focus of the ongoing legal battle before the IPTAB.
