LG Chem Challenges One of Tiax Patents Licensed to EcoProBM

LG Chem has launched an invalidation challenge against one of the two South Korean patents licensed to EcoProBM by U.S.-based battery technology firm Tiax LLC.

In April 2023, LG Chem filed an invalidation trial with the Korean Intellectual Property Trial and Appeal Board (KIPTAB) targeting Korean Patent No. 2068513, which covers polycrystalline metal oxide materials used in battery applications. The patent is one of two that were later licensed non-exclusively to EcoProBM in July 2024.

EcoProBM secured the license after a separate invalidation attempt by Umicore Korea failed. Umicore had filed a trial against both KR2068513 and KR1971442 in April 2023 but withdrew its petition the following month, leaving the patents intact at the time.

The licensed patents — KR1971442 and KR2068513 — are titled “Polycrystalline Metal Oxide, Methods of Manufacture Thereof, and Articles Comprising the Same.” The non-exclusive license granted EcoProBM the right to use the patented technology without exclusivity.

Umicore and its Korean affiliate have also faced setbacks in defending their own patents. In 2022, Ningbo Ronbay New Energy Technology successfully invalidated Umicore’s Korean patent on positive electrode materials (KR1821530). Umicore filed a lawsuit to overturn the ruling in January 2023 but withdrew the case a month later, resulting in the patent’s cancellation.
