Top Fails To Secure Non-Infringement Ruling Against GUSIM ENG Patent

Top Co. Ltd. has failed to persuade South Korea's Intellectual Property Trial and Appeal Board (KIPTAB) that it does not infringe a patent held by GUSIM ENG, after the Board rejected its non-infringement petition.

In a decision issued Nov. 7, 2025, KIPTAB dismissed Top's petition seeking a declaration that its product does not fall within claim 1 of GUSIM ENG's patent titled "Apparatus for Heat Bonding Film to Lead Tab of Secondary Battery" (KR 2180608). Top had filed the petition in January 2025, asserting that its process and equipment differ from the patented invention.

The disputed technology covers a film-bonding apparatus used to thermally fuse protective films onto the lead tabs of secondary batteries. 

According to the patent specification, the system feeds film from a roll, guides and presses it using an attachment roller, applies heat to cut metal lead tabs, and bonds the film to the tabs through thermal fusion. The invention aims to improve insulation, mechanical protection, and heat resistance, particularly in pouch-type lithium-ion batteries.
