South Korea–based Top Co., Ltd. has filed a negative scope confirmation trial with the Korean Intellectual Property Trial and Appeal Board (KIPTAB), seeking a ruling that its technology does not fall within the scope of GUSIM ENG's Korean patent titled Apparatus for Heat Bonding Film to Lead Tab of Secondary Battery (Registration No. KR2180608).
A negative scope confirmation trial is used to confirm that a particular product or process does not infringe a registered patent. While distinct from civil patent litigation, the outcome of such trials often serves as key evidence in determining infringement, though it does not carry binding force in related civil cases.
The disputed invention relates to a film bonding apparatus used to fusion bond protective films onto the lead tabs of secondary batteries. According to the patent specification, the system supplies film in roll form, guides and presses it with an attachment roller, applies heat to cut metal lead tabs, and bonds the film to the tabs using thermal fusion. The technology is expected to enhance insulation, mechanical protection, and heat resistance, especially in pouch-type lithium-ion batteries.
In the scope confirmation trial, Top argues that its product does not fall within the scope of claim 1 of the asserted patent.
