Milaebo Renews Push To Invalidate MMTK Semiconductor Patent In Korea

Korean chip equipment maker Milaebo has launched a fresh bid to invalidate a semiconductor-related patent held by Modern Materials Technology Korea (MMTK), taking the dispute to the Patent Court of Korea.

Milaebo filed a civil suit in May 2025 seeking to overturn a KIPTAB ruling that upheld the validity of MMTK's patent titled "A Collecting Byproduct Trapping Device for Semiconductor Manufacturing Process" (Patent No. 2316093). The lawsuit, known as a "trial decision cancellation action," challenges KIPTAB's March 2025 decision rejecting Milaebo's earlier invalidation petition.

Milaebo had initially argued in December 2023 that claims 1, 3–4, and 6–10 of the patent were invalid, but KIPTAB dismissed those arguments.

The disputed patent covers a trap device designed to capture byproducts such as tungsten, titanium, and carbon during semiconductor fabrication. These devices are critical to maintaining clean gas flows and minimizing contamination in downstream equipment, ultimately extending the life of chipmaking tools.
