Toppan's Korean Decorative Sheet Patent Revoked in Cancellation Trial

Japan's Toppan Inc has seen its Korean patent for a decorative sheet technology nullified following a cancellation trial decision by the Korean Patent Tribunal.

The patent in question—titled "Resin Molded Body, Laminate And Decorative Sheet" (Registration No. KR2532688)—had been at the center of a cancellation proceeding initiated in November 2023. On February 28, 2025, the Tribunal ruled in favor of the cancellation claim, annulling claims 1 through 6, as well as claims 16 and 17 of the patent.

Under Korean law, a cancellation trial can be filed within six months of a patent's registration, and notably, such proceedings may be initiated by any interested party—even competitors who prefer to remain behind the scenes. This mechanism, however, presents a double-edged sword: while it permits broader challenges to a patent's validity, a surviving patent in the face of a cancellation trial might face increased hurdles in subsequent invalidation proceedings, given the deference typically afforded to earlier Tribunal determinations.

The technology covered by the patent spans resin molded bodies and laminates used in decorative sheets for various applications, including building interior components such as architectural cladding, entrance doors, window facades, and surfaces in consumer electronics. 

Notably, Toppan's Korean family patents—filed under application numbers KR1020237007702 and KR1020237007700 and titled "Resin Molded Product, Laminate And Decorative Sheet"—are publicly disclosed, and the corresponding U.S. patent (US11021598), also titled "Resin Molded Product, Laminate And Decorative Sheet," was registered in June 2021.
