Korean environmental equipment manufacturer Bluebird has successfully invalidated a patent held by competitor Emko.
On March 27, 2025, the Korean Intellectual Property Trial and Appeal Board (KIPTAB) ruled to invalidate Korean Patent No. 2159082, titled "Method for Treating Exhaust Gas of Thermal Plant," following a petition filed by Bluebird in June 2024.
The invalidated patent claimed a method for treating exhaust gas generated during the startup of gas turbines in combined-cycle thermal power plants. According to the patent specification, Emko's invention addresses high concentrations of nitrogen dioxide (NO₂), which are commonly released during initial turbine operation. Emko argued that conventional technologies failed to adequately respond to the fluctuating flow rate, velocity, and temperature of exhaust gases under such dynamic conditions.
The ruling marks the first patent dispute between Bluebird and Emko before the KIPTAB. While Emko has been relatively quiet on the IP front, Bluebird has shown a more aggressive stance in past patent enforcement and defense efforts.
