Emko Co. has filed an civil lawsuit with the Patent Court of Korea, seeking to overturn a March 2025 decision by the Korean Intellectual Property Trial and Appeal Board (KIPTAB) that invalidated its patent related to exhaust gas treatment in thermal power plants.
The lawsuit, filed in May 2025, challenges the invalidation of Korean Patent No. 2159082, titled "Method for Treating Exhaust Gas of Thermal Plant." The invalidation trial had been initiated in June 2024 by Bluebird Co., which argued that the patent lacked novelty or inventive step. KIPTAB ultimately sided with Bluebird, nullifying the patent in full.
Emko has not yet pursued a correction trial to amend the scope of its patent claims, a step commonly taken by patentees facing the risk of invalidation.
The challenged patent describes a method for managing exhaust gases emitted during the startup phase of gas turbines in combined-cycle thermal power plants. According to the specification, Emko’s technology addresses high levels of nitrogen dioxide (NO₂) released during initial turbine operation—conditions where exhaust gas flow, velocity, and temperature fluctuate rapidly. Emko claimed that prior technologies failed to maintain effective pollutant control under such dynamic conditions.
