Korean Patent Tribunal Rejects Challenges to CATL Patents

The Korean Intellectual Property Tribunal (KIPT) has dismissed two cancellation requests against patents owned by China's Contemporary Amperex Technology Co. Ltd. (CATL), marking a win for the battery giant in South Korea.

In late January 2025, the KIPT ruled against petitions seeking to invalidate CATL's patents titled "Separator, preparation method therefor, and related secondary battery thereof, and battery module, battery pack, and device" (KR2537203) and "Separator film, secondary battery containing same, related battery module thereof, battery pack and device" (KR2536847). Both petitions were dismissed in full.

The challenges, filed in November 2023, aimed to revoke claims 1-23 of KR2537203 and claims 1-9, 11-22, and 24-27 of KR2536847. However, the tribunal declined to accept the requests, allowing both patents to remain in force.

KR2537203 references Samsung SDI's patent "Separator, method for preparing the same, and lithium battery comprising the same" (KR2210884). The patent has family applications in multiple jurisdictions, including the U.S., Europe, China, and Japan.

Meanwhile, KR2536847 cites prior patents from Japan's Murata Manufacturing Co. Ltd., including "Separator, non-aqueous electrolyte battery, battery pack, electronic device, electric vehicle, electricity storage device, and power system" (KR1979053) and "Separator, battery, battery pack, electronic apparatus, electric vehicle, power storage device, and power system" (KR2130867), as well as a patent from Nippon Zeon Co. Ltd. titled "Separator for non-aqueous secondary battery, manufacturing method therefor, and non-aqueous secondary battery" (KR2477891). Like KR2537203, this patent also has filings in the U.S., Europe, China, and Japan.
