The Korean Intellectual Property Trial and Appeal Board (KIPTAB) has canceled the registration of the patent "Carbon Nanotube Dispersion and Usage Therefor" (KR2528285), co-owned by Japan-based Artience and Toyocolor.
The November 2024 decision invalidated claims 1 through 9 of the patent, following a cancellation request filed in September 2023.
Under South Korean patent law, patents within six months of registration may be challenged by any party, regardless of their direct interest. This provision allows competitors to anonymously file cancellation requests, avoiding direct exposure while targeting rival patents.
Artience and Toyocolor previously touted the patent's application, stating that "the carbon nanotube dispersion described in this invention enables the production of resin compositions, composite slurries, and electrode films with exceptional conductivity." They further emphasized its utility in fields requiring high conductivity, including lithium-ion batteries, composite materials (resin and rubber), and coatings.
Carbon nanotube (CNT) dispersion technology plays a critical role in various industries, particularly as a conductive agent in lithium-ion batteries, reinforcing materials in composites, and in specialized coatings.
