Artience, Toyocolor Drop Appeal Over Canceled Carbon Nanotube Dispersion Patent

Japanese companies Artience and Toyocolor have withdrawn their appeal against the cancellation of their carbon nanotube dispersion patent (KR2528285), effectively confirming the Korean Intellectual Property Trial and Appeal Board (KIPTAB)'s earlier invalidation decision.

On March 13, 2025, Artience and Toyocolor filed for withdrawal of their suit at the Patent Court of Korea, where they had challenged the cancellation decision. The companies initially brought the action in January 2025.

The dispute stemmed from a November 2024 ruling by KIPTAB, which invalidated claims 1 through 9 of the patent following a cancellation request filed by an individual in September 2023. The tribunal accepted the petition, leading to the revocation of the patent registration.

Under Korean law, any party—regardless of direct interest—may file a patent cancellation request within six months of a patent's registration.

As of March 15, 2025, Artience and Toyocolor hold 13 patent applications in Korea that include "carbon nanotube" in their titles. Among them, four are registered, eight have been published, and one has been withdrawn. The recently canceled patent remains listed as registered as of March 15, 2025.

Carbon nanotube (CNT) dispersion technology plays a crucial role in multiple industries, serving as a conductive agent in lithium-ion batteries, a reinforcement material in composites, and a key component in specialized coatings.
