Soulbrain has successfully defended its Korean patent titled "Etching Composition, Etching Method, and Semiconductor Device" (No. 2365046) in a legal battle initiated by NEX. The patent was challenged through both a cancellation request and an invalidation trial, but Soulbrain ultimately succeeded in protecting its intellectual property.
The dispute began when a cancellation request against Soulbrain’s patent was filed by an individual in August 2022. In June 2023, the Korean Intellectual Property Tribunal (KIPT) ruled to cancel Claims 1 and 3 through 5 of the patent, while dismissing the cancellation request for Claim 2. In response, Soulbrain appealed this decision by filing a lawsuit in the Patent Court in August 2023.
By June 2024, the Patent Court ruled in favor of Soulbrain, overturning the previous KIPT decision. Following the court's ruling, the case was remanded to the KIPT, which issued a partial dismissal and partial rejection on July 16, 2024, allowing Soulbrain's patent to remain intact.
In August 2023, while Soulbrain filed a lawsuit in the Patent Court to overturn a prior decision, NEX initiated an invalidation trial against Soulbrain's patent. NEX argued that all claims 1 through 5 of the patent were invalid.
However, in October 2023, KIPT recognized the patent amendment, dismissing the invalidation trial against claims 1 and 3 through 5, and rejecting the request for claim 2. The decision from the invalidation trial was finalized in November 2023.
In South Korea, the invalidation trial and cancellation request are treated as separate proceedings, with each process being conducted independently.
