Seoul-based Kum Moon Steel has successfully invalidated an amendment to a patent owned by Hanguk Iron & Steel Industry, headquartered in Yangsan, South Gyeongsang Province.
The Korean Intellectual Property Trial and Appeal Board (KIPTAB) on October 31, 2025, ruled that Hanguk Iron & Steel's amendment to its patent titled "Apparatus for Manufacturing Rebar Pile Cage" (KR1853733) is invalid.
The patent covers a machine for the automatic fabrication of rebar pile structures, specifically an automated apparatus that rotates multiple main rebars while spirally winding and welding hoop rebars along their outer surfaces.
Kum Moon Steel filed the invalidation trial against the amendment after the KIPTAB had initially accepted Hanguk Iron & Steel's correction request in June 2025. With the latest ruling, the Board sided with Kum Moon Steel, placing the patent owner, Hanguk Iron & Steel, at a disadvantage.
The dispute follows an earlier December 2024 KIPTAB decision, which held that claims 1, 4, 6, 8, 9, and 12 of the same patent were invalid. Hanguk Iron & Steel subsequently filed a patent court appeal in February 2025, which remains pending.
