LG Uplus has filed a patent invalidation trial before South Korea's Intellectual Property Trial and Appeal Board (KIPTAB), targeting a now-expired patent owned by Frontier IP that covers a smartphone-based system for controlling multiple digital devices.
The invalidation petition, filed in December 2023, challenges Korean Patent No. 1037397, titled "Digital Device Controlling System by Utilizing Smartphone." Although the patent expired in 2022 due to non-payment of renewal fees, South Korean law allows patent owners to pursue damages for infringement that occurred while the patent was in force—making expired patents potentially enforceable in litigation.
Frontier IP acquired the patent in 2019 from a previous owner, Necon. The patented technology describes a system in which a smartphone connects to a central controller via Bluetooth or Wi-Fi. The controller then communicates with multiple digital devices using infrared LEDs, enabling users to control multiple devices remotely—even in blind spots or over long distances—through a single mobile interface.
The outcome of the invalidation trial may determine whether Frontier IP can assert the patent in any future infringement claims involving its remote-control technology.
