McCoy E&C's Patent Infringement Claim Against NES Materials Dismissed

McCoy E&C's attempt to prove that NES Materials Corporation infringed its patent has been unsuccessful.

On April 17, 2025, the Korean Intellectual Property Trial and Appeal Board (KIPTAB) dismissed McCoy E&C's request for a declaratory judgment in a patent rights scope confirmation trial. The trial is a procedure in which a party seeks a decision from the KIPTAB regarding whether their patent has been infringed by another party.

McCoy E&C had filed the petition in February 2024, claiming that NES Materials Corporation had infringed its patent, titled "Apparatus of manufacturing for ultra pure electronics grade sulphuric acid" (Registration No. KR1541908). This was McCoy E&C's first attempt to seek a patent infringement ruling from the KIPTAB.

The patent in question relates to the manufacturing of ultra-pure electronics-grade sulfuric acid, a technology that can be used in the semiconductor and electronics manufacturing processes. It describes a device for producing high-purity sulfuric acid safely and efficiently, which is crucial in semiconductor manufacturing processes such as cleaning, etching, and chemical mechanical polishing (CMP).

The term "electronics-grade" refers to high-purity chemicals used in the production of electronic devices, where impurities must be kept to a minimum. Electronics-grade sulfuric acid, for example, requires a purity level of iron under 50 parts per trillion (ppt). This ultra-pure acid is used in various processes in semiconductor production.

In terms of financial performance, NES Materials Corporation reported a 2024 revenue of 3.3 billion KRW, an operating loss of 11.3 billion KRW, and a net loss of 12.1 billion KRW. In comparison, the company's 2023 performance showed a revenue of 1.1 billion KRW, an operating loss of 5.9 billion KRW, and a net loss of 4.3 billion KRW.
