YKK Invalidates Two 3M Patents in S. Korea

In January 2024, Japan's YKK Corporation successfully invalidated two patents held by American multinational 3M in South Korea. 

The patents in question—KR2197781, titled "Mechanical Fastener, Fastening System, and Disposable Absorbent Article," and KR2245694 with the same title—were rendered void following a legal battle initiated by YKK. 

YKK filed a patent invalidation trial in November 2022, arguing that claims 1 and 3-6 of the '781 patent, and claims 1-4 of the '694 patent, were invalid. While 3M attempted to amend the patents, the Korean Intellectual Property Tribunal sided with YKK and accepted the invalidation request in full, leading to the cancellation of both patents. 

Both invalidated patents covered technology related to mechanical fasteners used in absorbent products such as disposable diapers and sanitary pads. The fasteners incorporate thermoplastic backing and post structures, featuring upright fastening elements designed to interlock with other components. Despite the use of thermoplastic materials and similar structures in both patents, they were successfully challenged and are no longer enforceable.
