Following a patent infringement lawsuit filed by ASUS against Samsung Electronics, Samsung has responded by filing Inter Partes Review (IPR) petitions challenging the validity of all the ASUS patents in question. The Patent Trial and Appeal Board (PTAB) has not yet decided whether to institute the five IPR proceedings.
In September 2023, Asus Technology Licensing Inc. and Celerity IP, LLC initiated a patent infringement lawsuit against Samsung Electronics Co., LTD., Samsung Electronics America, Inc., and Samsung Research America in the U.S. District Court for the Eastern District of Texas.
In their complaint, ASUS and its affiliates alleged that Samsung’s smartphones, tablets, and smartwatches infringe upon five of ASUS’s wireless communication Standard Essential Patents (SEPs). They further claimed that Samsung failed to engage in licensing negotiations based on FRAND (Fair, Reasonable, and Non-Discriminatory) commitments.
Subsequent to the filing of the lawsuit, Samsung filed IPR petitions between March and August 2024, challenging the validity of all five patents. The PTAB has yet to determine whether these IPR proceedings will be instituted.
