Petitions target Kolon's US tire cord patents amid ongoing infringement litigation

HS Hyosung Advanced Materials has launched a counteroffensive in U.S. patent litigation by filing inter partes reviews (IPRs) with the Patent Trial and Appeal Board (PTAB) against three patents held by Kolon Industries Inc.
The IPRs target Kolon's U.S. tire cord patents: US9,617,663 (Hybrid tire cord and method for manufacturing the same), US9,789,731 (Hybrid fiber cord and method for manufacturing the same), and US10,196,765 (Hybrid tire cord and method for manufacturing the same).
The filings, submitted in February 2025, come in response to Kolon Industries' earlier allegations. In February 2024, Kolon initiated a patent infringement lawsuit in the California Central District Court, asserting that Hyosung Corp. and HS Hyosung Advanced Materials had infringed these three patents.
HS Hyosung Advanced Materials' petition was filed one year after Kolon Industries' patent infringement lawsuit against Hyosung in the California court.
Under federal civil procedure rules, a defendant in a patent infringement case can file for an IPR within one year of the lawsuit's initiation. If filed within this period, the federal court may consider the PTAB's decision during the ongoing litigation. The PTAB typically decides whether to institute an IPR within approximately six months of the petition filing.
HS Hyosung Advanced Materials' filing follows the standard timeline, challenging Kolon's patents while the infringement case continues in court.
